Jefferson County Schools Career Portal Terms of Use

1. Lawful Use. You agree not to use the Jefferson County Schools Career Portal website (the "Site") for any unlawful or abusive purpose, or in any way that interferes with Jefferson County Schools’ (also referred to herein as "we," "us," and in the possessive, "our") ability to provide access to the Site or to provide any other service to our users, or in any way that damages our property or the property of others. You are solely responsible for all content you transmit through the Site.

2. Fraudulent Use. You must safeguard your password to prevent unauthorized persons from accessing your account information, and you acknowledge that Jefferson County Schools cannot verify the identity of persons using the Site under your password. Jefferson County Schools is not responsible for the use of lost or stolen password information. You agree that the password you use to access an account through the Site will be kept confidential. If you forget your password, you may reset your password online. You understand that you have sole responsibility for the security of your password. You are responsible for notifying us immediately of the loss or theft of a password. We will not be liable for any actions, claims, costs, damages, or expenses arising from a lost or stolen password. Should you allow others access to your online account information, you will be responsible for all actions of such persons. If you suspect that your account has been fraudulently used or otherwise compromised, you shall immediately notify us.

3. You agree that Jefferson County Schools has the right, at its sole option, to access and review any account on this Site and to modify, alter or terminate access to any account on the Site at any time at its exclusive discretion.

4. Copyrights. The images, text, programs and other materials found on the Site are protected by the United States copyright laws. Any commercial use of the images, text, programs or other materials found in the Site without the express written consent of Jefferson County Schools is strictly prohibited.

5. Indemnification. You agree to indemnify, defend and hold Jefferson County Schools, its board of commissioners, employees, agents, suppliers and any third party information providers for the Site from and against all losses, expenses, damages and costs, including reasonable attorneys’ fees, resulting from any violation of these terms and conditions. The provisions of this paragraph are for the benefit of Jefferson County Schools and its directors, employees, agents, and suppliers of the Site. Each of these individuals or entities shall have the right to assert and enforce these provisions directly against you on its own behalf.

6. Except for information or services provided by Jefferson County Schools, all information and services offered through the Site or on the Internet generally are offered by third parties that may not be affiliated with Jefferson County Schools. It is also understood that Jefferson County Schools cannot and does not guarantee or warrant that files available for downloading through the Site will be free from infection or viruses, worms, Trojan horses or other digital codes that manifest contaminating or destructive properties. You are responsible for implementing sufficient procedures and checkpoints to satisfy your particular requirements for accuracy of data input and output, and for maintaining a means external to the Site for the reconstruction of any lost data.

7. WARRANTIES DISCLAIMED. YOU ASSUME TOTAL RESPONSIBILITY AND RISK FOR YOUR USE OF THE SITE AND THE INTERNET. ALL SERVICES PROVIDED BY Jefferson County Schools THROUGH THE SITE ARE PROVIDED "AS IS". Jefferson County Schools AFFIRMATIVELY DISCLAIMS ALL WARRANTIES, REPRESENTATIONS OR ENDORSEMENTS, EXPRESS OR IMPLIED WHATSOEVER (INCLUDING WITHOUT LIMITATION WARRANTIES OF TITLE OR NON-INFRINGEMENT, OR THE IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE), WITH REGARD TO THE SITE, ANY SERVICES OFFERED THROUGH THE SITE, OR ANY TRANSACTION PERFORMED THROUGH THE SITE OR ON THE INTERNET GENERALLY. Further, WE MAKE NO WARRANTY THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR FREE OR that the site WILL MEET YOUR individual REQUIREMENTS FOR QUALITY or SECURITy. Jefferson County Schools’S DESCRIPTION OF THE SERVICEs herein provided in no way constitutes A WARRANTY.

8. LIMITATION OF LIABILITY. Jefferson County Schools will NOT BE LIABLE FOR ANY COSTS OR DAMAGES ARISING EITHER DIRECTLY OR INDIRECTLY FROM ANY TRANSACTION RELATED TO THE SITE OR ANY SERVICES OFFERED THROUGH THE SITE. IN NO EVENT WILL Jefferson County Schools BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, OR INDIRECT DAMAGES (INCLUDING, BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF PROGRAMS OR INFORMATION, etc.) ARISING OUT OF THE USE OF, OR INABILITY TO USE THE SITE, ANY SERVICES OFFERED THROUGH THE SITE, ANY TRANSACTIONS PERFORMED THROUGH THE SERVICE, OR ANY INFORMATION DOWNLOADED OR HYPER-LINKED FROM THE SITE, EVEN IF Jefferson County Schools OR ITS AUTHORIZED REPRESENTATIVES HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

9. Governing Law. This Agreement shall be governed and construed in accordance with the laws of the State of Tennessee. You agree that in any legal action or proceeding between you and Jefferson County Schools for any purpose concerning this Agreement, you will submit to exclusive jurisdiction of appropriate Tennessee Trial Courts located in Jefferson County, Tennessee.

10. Waiver. Jefferson County Schools’ failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement.
